1780s court case lists death as 1762, but brother Francis' will speaks of "where brother John lived" making it sound like he was dead by 1750. There are lots of contradictions between this court case and other documentation. This is probably the John who has the oral will recorded in Spotsylvania Will Bk B:80. It says explicitly that he died Christmas day 1750. George H. S. King says that John is the one who marries in Middlesex County VA. Wm Robinson was one of the ones who heard his oral will.

John is a pillar of Caroline County. He is an early sheriff, serves on the court, a justice of the peace, builds a warehouse at the wharf, inspects the weights, and about all the other things leading lights do. John is generally listed as having but two sons, Francis and John. The Caroline County COB indicate, however, that he probably had more. They might all be born after 1725 when his brother Robert's will (which the 2 son thesis is based) was probated. Robert and Francis are exec of his estate. King thinks that the son John is the son of a first wife, and that Agatha is a second wife, married later. This is because a 1713 deed gives a mare to Agatha Hay. King establishes Agatha as a Hay based on an affadavit of Edmund Pendleton. King also says that son Francis is younger than son John and probably a son of Agatha Hay, since he seems to inherit Hay Mount. I am suspicious of the linkage to John of Dissington although everyone seems to think it is. John of Dissington's son, Francis, names Francis of Spotsylvania his guardian, not Francis of Hay Mount. John's executors are Robert and Francis. If John of Dissington is a son and has moved to King George, then it makes sense that Robert is another son and one of the Roberts in Caroline, almost certainly Robert of Blenheim who names a son Hay.
